This website is operated by KIMAIAN, a brand of handcrafted limited-edition kimonos and abayas based in Dubai, UAE, registered as a sole trader in France.

By visiting our site and/or placing an order, you unconditionally accept these General Terms and Conditions ("Terms"). These Terms apply to all users of the site — visitors, customers and contributors alike.

We reserve the right to update these Terms at any time. The version in force is the one displayed on this page. Your continued use of the site after any update constitutes acceptance of the revised Terms.

Access to kimaian.com is open to any person of legal age or with parental consent. By placing an order, you declare that you have full legal capacity to be bound by these Terms.

We reserve the right to refuse access to the site or to cancel any order at any time and for any reason, including in cases of suspected fraud or violation of these Terms.

Our website is hosted by Shopify Inc., which provides the e-commerce platform enabling the sale of our products.

All KIMAIAN creations are produced in limited edition and handcrafted. Available quantities are strictly limited and items may sell out without notice.

Due to the handmade nature of our pieces, slight variations may exist between items in colour, texture and finish. These are not defects — they are what makes each creation unique. Colours may also vary depending on your screen's display settings.

We reserve the right to modify or discontinue any product at any time, without notice and without liability.

Prices are displayed in euros (€) and may adapt automatically to your location. The applicable price is the one in force at the time your order is confirmed. Prices are subject to change without notice.

We accept: Visa, Mastercard, American Express, PayPal, Shop Pay, Klarna and Apple Pay. All payments are secured and processed by certified providers. KIMAIAN never has access to your banking details.

An order is only confirmed once payment has been successfully validated. We reserve the right to cancel any order in the event of suspected fraud or payment anomaly.

We occasionally offer promotional codes to our newsletter subscribers and on social media. Only one code may be applied per order. Codes cannot be combined with other offers.

Any order placed on kimaian.com constitutes a sales contract between you and KIMAIAN. You will receive a confirmation email once your order and payment have been validated.

Modifications or cancellations are only possible before dispatch. Once a shipping label has been created or the parcel handed to the carrier, no changes can be made. You may then return the item in accordance with our Returns Policy.

We reserve the right to limit or refuse orders that appear to be placed for resale purposes or in unusually high quantities.

All orders are shipped from Dubai, United Arab Emirates. Full shipping conditions are detailed in our Shipping Policy.

Customs duties, import taxes and clearance fees are the sole responsibility of the recipient. KIMAIAN cannot be held responsible for delays caused by customs processing, carrier disruptions or force majeure events.

Risk of loss passes to the customer upon carrier acceptance of the parcel.

• Return period — 14 calendar days from receipt
• Items bought with a promo code — exchange only, no refund
• Return shipping — customer's responsibility, except for defective items or our error
• Exchanges — subject to availability; all pieces are limited edition

Customers residing in the European Union benefit from the protections of Directive 2011/83/EU, including the 14-day right of withdrawal.

Payment is charged in full at order confirmation to reserve your piece. By placing a pre-order, you accept the following:

• Immediate payment to secure your item
• Estimated dispatch date indicated on the product page — subject to adjustment in case of production or logistics delays
• Mixed orders — if your order includes a pre-order item and an in-stock item, everything ships together once the pre-order is available. We do not split shipments.
• Cancellation is possible at any time before dispatch, for a full refund

Reviews published on kimaian.com are authentic and submitted by customers who have genuinely placed an order. We reserve the right to remove any review that is fraudulent, defamatory, abusive or unrelated to an actual purchase experience.

By submitting a review, you grant KIMAIAN the right to publish and use it for communication purposes.

All content on kimaian.com — texts, photographs, logos, designs, product names and visuals — is the exclusive property of KIMAIAN and is protected by applicable intellectual property laws.

Any reproduction, duplication, copying, sale or exploitation of any part of our content without express written permission from KIMAIAN is strictly prohibited.

By using our site, you agree not to:

• Use the site for any unlawful or unauthorised purpose
• Transmit viruses, malware or any destructive code
• Collect personal information of other users
• Impersonate any person or entity
• Attempt to circumvent the site's security measures
• Reproduce or exploit our content without written authorisation

Any violation of these rules will result in immediate termination of your access to our services.

To the extent permitted by law, KIMAIAN shall not be liable for any indirect, incidental or consequential damages resulting from the use of, or inability to use, our service.

You agree to defend, indemnify and hold KIMAIAN and its collaborators harmless from any claim or demand arising from your breach of these Terms or violation of any applicable law.

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be deemed severable and will not affect the validity of the remaining provisions.

These Terms, together with our Shipping Policy, Returns Policy and Privacy Policy, constitute the entire agreement between you and KIMAIAN and supersede any prior agreements.

These Terms are governed by and construed in accordance with the laws of Dubai, United Arab Emirates.
